Evolution of Sports Betting Regulation in Brazil: From Legalization to Oversight

The process of legalizing sports betting in Brazil began in 2018, was regulated during Lula's government, and culminated with the creation of the Secretariat for Prizes and Betting (SPA) in 2024 to oversee an industry that had been expanding without adequate supervision.

The legalization and regulation of sports betting in Brazil have been a continuous process, initiated by the government of Michel Temer in 2018 with Law nº 13.756, which allowed for both physical and digital sports betting operations. The legal framework gained more structure and control during Luiz Inácio Lula da Silva's government at the end of 2023, through Law nº 14.790, which introduced the need for authorization from the Ministry of Finance, as well as a fiscal mechanism through an outlay fee and tax on gross revenue. These measures aim not only to regulate the market but also to maximize fiscal benefits for the Union, directed towards the National Fund for Public Security (FNSP). The next step was the creation of the Secretariat for Prizes and Betting (SPA) in January 2024, to regulate and oversee these activities. This structure aims to consolidate control over an industry that was expanding without adequate supervision during Jair Bolsonaro's government. The legalization and regulation of sports betting in Brazil reflect global trends towards liberalization of gaming markets with the ultimate goal of generating significant tax revenues and promoting greater transparency in the sector.
