New Insurance Law: Legislative Framework Takes Effect - Impacts and Challenges in the Market

The Lei 15.040/2024 takes effect in December 2025, unifying insurance rules in Brazil. While offering potential benefits in terms of legal security and transparency, the new law faces regulatory and practical challenges, especially for complex corporate insurance.

In December 2025, the Lei 15.040/2024, known as the Legal Framework for Insurance, came into effect after a year of adaptation. This legal framework aims to consolidate insurance rules and relationships between insurers and policyholders that were previously scattered across the Civil Code, Decree-Law No. 73/1966, and case law. The change brings greater legal security and transparency for consumers but still requires further regulation, particularly regarding complex corporate insurance. Companies like Icatu and MetLife have already prepared by revising products, contracts, internal systems, and processes to incorporate the new requirements. However, experts point out that the equal treatment approach for mass-market and corporate insurance may pose challenges in practice, depending on future Susep regulations. This new legal framework represents a crucial step in the development of Brazil's insurance sector, aligning with global trends towards modernization and standardization of financial markets.
